1. Introduction
These Terms and Conditions ("Terms") govern the use of Suzuverse's card services ("Service"), which are issued in partnership with MatchMove, a fintech company in digital payments. By using our Service, you agree to comply with and be bound by these Terms as well as MatchMove's Terms and Conditions. Please read them carefully before using the Service. If you do not agree to these Terms, please refrain from using the Service.
2. Eligibility
To be eligible for the Suzuverse card, you must be at least 18 years of age and possess the legal capacity to enter into a binding agreement. Additionally, you must comply with all applicable laws and regulations governing the use of financial services. By using the Service, you represent and warrant that you meet the eligibility requirements.
3. Registration and Account Security
In order to register for the Suzuverse card, you must provide accurate, current, and complete information as required by the registration process. You are solely responsible for maintaining the confidentiality of your account details and for all activities that occur under your account. You agree to notify us immediately if you become aware of any unauthorized access to or use of your account. Suzuverse disclaims liability for any losses arising from your failure to safeguard your account information.
4. Use of the Suzuverse Card
The Suzuverse card, issued in collaboration with MatchMove, can be used to make payments at participating merchants. You agree to use the card lawfully and in compliance with all applicable laws, these Terms, and MatchMove’s Terms and Conditions. The card must not be used for any prohibited activities, including but not limited to fraudulent or illegal transactions.
MatchMove is responsible for the issuance, management, and operation of the Suzuverse card, including financial transactions, fees, and card functionalities. Suzuverse manages the marketing and customer support for the card. Both companies’ Terms and Conditions apply to your use of the card.
By using the Suzuverse card, you acknowledge and agree to fully comply with MatchMove’s policies, rules, and terms of service. All financial transactions, fees, and card functionalities are governed by MatchMove. Any disputes or issues specifically related to the card’s usage will be addressed according to MatchMove’s guidelines. 5. Fees and Charges
You are responsible for all fees and charges associated with the use of the Suzuverse card. These may include transaction fees, foreign exchange fees, and maintenance charges, among others, as specified by MatchMove. Any changes to these fees will be communicated to you in advance, and your continued use of the card following such notification will constitute acceptance of the updated fees and charges.
6. Privacy and Data Protection
Your privacy is of the utmost importance to us. By using the Suzuverse card, you consent to the collection, use, and disclosure of your personal information as outlined in our Privacy Policy and in MatchMove’s Privacy Policy. Suzuverse is committed to ensuring that your personal information is handled in compliance with applicable data protection laws. We employ reasonable security measures to protect your information from unauthorized access or disclosure.
7. DISCLAIMERS
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES, EITHER EXPRESS OR IMPLIED. SUZUVERSE MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND REGARDING THE FUNCTIONALITY OR AVAILABILITY OF THE SERVICE OR THE SUZUVERSE CARD. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ALL IMPLIED WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT, ARE HEREBY EXCLUDED. SUZUVERSE DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, NOR THAT ANY DEFECTS WILL BE CORRECTED.
8.LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY LAW, SUZUVERSE, MATCHMOVE, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, AND LICENSORS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, OR ANY OTHER INTANGIBLE LOSSES RESULTING FROM THE USE OR INABILITY TO USE THE SERVICE OR THE SUZUVERSE CARD. IN NO EVENT SHALL SUZUVERSE'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT YOU HAVE PAID TO SUZUVERSE FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM. THIS LIMITATION APPLIES EVEN IF SUZUVERSE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
SUZUVERSE AND MATCHMOVE ARE NOT LIABLE FOR ANY INTERRUPTIONS, DELAYS, OR FAILURES OF THE SUZUVERSE CARD OR THE SERVICE DUE TO CAUSES BEYOND THEIR CONTROL, INCLUDING BUT NOT LIMITED TO NATURAL DISASTERS, GOVERNMENTAL ACTIONS, OR TECHNICAL FAILURES. THE SUZUVERSE CARD IS ISSUED AND MANAGED BY MATCHMOVE, AND SUZUVERSE DISCLAIMS ANY LIABILITY ARISING FROM OR RELATED TO THE PERFORMANCE, FUNCTIONALITY, OR MISUSE OF THE CARD.
9. Termination
Suzuverse reserves the right to terminate or suspend your access to the Service at its sole discretion, without prior notice, for any reason, including but not limited to a breach of these Terms or involvement in fraudulent or illegal activities. Upon termination, you will remain responsible for any outstanding fees or charges incurred prior to the date of termination. Suzuverse is not liable for any damages resulting from the termination or suspension of your account.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Japan for matters related to Suzuverse and the laws of Singapore for matters related to MatchMove. Any disputes arising from or relating to these Terms shall be resolved in the courts of Japan for Suzuverse-related issues and the courts of Singapore for MatchMove-related issues, to the extent permitted by law.
11. Changes to Terms
Suzuverse reserves the right to modify these Terms at any time. Any changes to the Terms will be posted on our website, and such modifications will take effect upon posting. Your continued use of the Service following the posting of revised Terms constitutes your acceptance of the changes. It is your responsibility to regularly review the Terms to ensure your compliance.
12. Dispute Resolution
In the event of any dispute arising from or relating to the use of the Suzuverse card, you agree to first attempt to resolve the matter informally by contacting Suzuverse's customer support team. If the dispute cannot be resolved informally, it shall be submitted to binding arbitration. For disputes related to Suzuverse, the arbitration shall be conducted in accordance with the rules of the Japan Commercial Arbitration Association (JCAA), and for disputes related to MatchMove, arbitration shall be governed by the Singapore International Arbitration Centre (SIAC).
